CLASS ACTION/JURY TRIAL WAIVER

PLEASE READ THESE RULES CAREFULLY TO ENSURE THAT YOU UNDERSTAND EACH PROVISION. THESE RULES CONTAIN A MANDATORY INDIVIDUAL BINDING ARBITRATION AND CLASS ACTION/JURY TRIAL WAIVER PROVISION, AS SET FORTH BELOW.

Sweepstakes Name: COLTON Texas Getaway Sweepstakes (“Sweepstakes”).

Sponsor: Colton Development Company LLC, 19350 State Highway 249, Ste 210, Houston, Texas 77070-3545 (“Sponsor”).

Administrator: Colton Development Company LLC, 19350 State Highway 249, Ste 210, Houston, Texas 77070-3545 (“Administrator”).

1. Entrant Eligibility. An “Entrant” is a person who (i) is a legal resident of any one of the 50 United States or the District of Columbia, excluding residents of New York and Florida, (ii) is at least 18 years old and has reached the age of majority in the state in which he/she resides as of the time of entering the Sweepstakes, (iii) possess valid driver’s license issued by a state governmental authority, (iv) is not on the US Bureau of Industry and Security’s Denied Persons or Entity Lists, is not on the US Treasury Department's list of Specially Designated Nationals, and is not on the US Department of Commerce's Table of Denial Orders, and (v) complies with the Method of Entry & Entry Requirements in Section 4 below. Officers, directors, shareholders, members, managers, partners, employees, agents, and representatives of Sponsor and Administrator, its parent company (if any), subsidiaries, affiliates, successors, assigns, and members of their immediate families (parents, siblings, children and spouses, regardless of where they live), and those persons living in the same household with such persons, whether related or not, are ineligible to enter. Winners will be required to sign an affidavit of eligibility, liability release and, unless prohibited by law, publicity release.

2. Sweepstakes Period. The Sweepstakes Period begins at 12:00:00 a.m. Central Time (“CT”) on June 1, 2026 and ends at 11:59:59 p.m. CT on August 31, 2026. The Sweepstakes Period is divided into three (3) monthly entry periods, each with its own prize and its own separate drawing, as follows: (a) the June Entry Period begins at 12:00:00 a.m. CT on June 1, 2026 and ends at 11:59:59 p.m. CT on June 30, 2026; (b) the July Entry Period begins at 12:00:00 a.m. CT on July 1, 2026 and ends at 11:59:59 p.m. CT on July 31, 2026; and (c) the August Entry Period begins at 12:00:00 a.m. CT on August 1, 2026 and ends at 11:59:59 p.m. CT on August 31, 2026. Entries are eligible only for the drawing associated with the Entry Period in which they are received. An Entrant who wishes to be eligible for more than one (1) Entry Period must submit a separate entry during each such Entry Period.

3. Disqualification. Without limitation, an Entrant may be disqualified, at Sponsor’s sole discretion, if (i) Entrant fails to meet the eligibility requirements in Section 1, (ii) Entrant fails to comply with the Method of Entry & Entry Requirements in Section 4, (iii) Entrant submits more than one (1) entry per Entry Period through any combination of entry methods, or (iv) Entrant violates or fails to comply with these Official Rules.

4. Method of Entry & Entry Requirements. NO PURCHASE IS NECESSARY TO WIN. MAKING A PURCHASE OR TAKING A HOME TOUR WILL NOT IMPROVE YOUR CHANCES OF WINNING. ODDS OF WINNING DEPEND UPON THE NUMBER OF ENTRIES RECEIVED. SEE BELOW FOR MORE DETAILS.

There are three (3) methods to enter the Sweepstakes. Each method provides one (1) entry. Limit one (1) entry per Entrant per Entry Period regardless of method used. No method of entry, including visiting a model home, improves an Entrant’s chance of winning. All entry methods provide an equal chance of winning.

Option 1: Model Home Visit (QR Code). During the applicable Entry Period, visit any participating Colton model home and scan the designated QR code to complete the online registration form. A model home visit is not required to enter or win; this is simply one of the available entry methods. Upon submission of a completed registration form, you will receive one (1) entry into the drawing for the Entry Period in which your entry is received.

Option 2: Free Online Entry. During the applicable Entry Period, visit the Sponsor’s online sweepstakes landing page and complete the registration form. Upon submission of a completed registration form, you will receive one (1) entry into the drawing for the Entry Period in which your entry is received. Click to fill out registration form.

Option 3: Free Alternative Method of Entry. You may enter without visiting a model home or completing the online form by mailing a handwritten entry request including your full legal name, mailing address, email address, and phone number to: Colton Development Company LLC, Texas Getaway Sweepstakes, 19350 State Highway 249, Ste 210, Houston, Texas 77070-3545. To be eligible for a given Entry Period, a written entry must be postmarked during that Entry Period. Each mailed entry is eligible only for the Entry Period in which it is received.

Entry Limits. Limit one (1) entry per Entrant per Entry Period, regardless of method of entry. An Entrant may enter in each of the three (3) Entry Periods, for a maximum of three (3) entries during the Sweepstakes Period, but no more than one (1) entry per Entry Period. All entries become the sole property of Sponsor.

5. Odds of Winning. ODDS OF WINNING DEPEND UPON THE TOTAL NUMBER OF ELIGIBLE ENTRIES RECEIVED IN THE APPLICABLE ENTRY PERIOD. Each Entrant receives one (1) entry per Entry Period entered. Each Entrant’s odds of winning a given Entry Period drawing are determined by dividing one (1) by the total number of eligible entries received in that Entry Period.

6. Prize. Three (3) prizes will be awarded, one (1) for each Entry Period. Each prize consists of a hotel gift card for a two-night stay at the property associated with that Entry Period, as follows: (a) for the June Entry Period, a gift card to Hotel Drover in Fort Worth, Texas; (b) for the July Entry Period, a gift card to Hotel Emma in San Antonio, Texas; and (c) for the August Entry Period, a gift card to Lone Star Court Boutique Hotel in Austin, Texas. Each prize is a $2,500 hotel gift card, for a total Approximate Retail Value (“ARV”) of all three (3) prizes of $7,500. Prizes are awarded as hotel gift cards only and are not redeemable for cash. No prize includes transportation, meals, incidentals, taxes, gratuities, or any other expenses not specifically described herein, and all such expenses are the sole responsibility of the applicable Winner. If requested, a Winner shall provide Sponsor with valid identification, valid driver’s license and/or a valid taxpayer identification number or social security number as a condition of the Prizes being awarded.

7. Selection & Notification of Winner. One (1) Winner will be determined for each Entry Period by random drawing conducted by Sponsor or its designated representative from all eligible entries received during that Entry Period, as follows: the June Entry Period drawing will be held on or before July 10, 2026; the July Entry Period drawing will be held on or before August 10, 2026; and the August Entry Period drawing will be held on or before September 10, 2026. Each drawing will be conducted using a random number generator or similar method of random selection. Each eligible entry has an equal probability of selection within its Entry Period.

Each Winner will be notified via email, phone, and/or text message using the contact information provided at the time of entry on or before the 15th day of the month following the close of the applicable Entry Period (that is, by July 15, 2026 for the June Entry Period, by August 15, 2026 for the July Entry Period, and by September 15, 2026 for the August Entry Period). Each Winner must respond to the notification within seven (7) calendar days of the date the notification is sent; otherwise, the prize will be forfeited. A Winner may be required to complete, sign, and return an affidavit of eligibility and publicity release within seven (7) calendar days of notification. Failure to timely return the documents and/or requested information, or the return of any prize or prize notification as being undeliverable, or if a Winner is determined by Sponsor to be ineligible, shall result in forfeiture of the prize. In the event of such forfeiture, Sponsor will select an alternate winner for that Entry Period by random drawing from the remaining eligible entries for that Entry Period. Up to two (2) alternate drawings will be held per Entry Period. If no valid winner is identified after two (2) alternate drawings for an Entry Period, the prize for that Entry Period will not be awarded. All decisions of Sponsor are final. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.

8. Taxes. The valuation of the prizes stated above is based on reasonably available information provided to the Sponsor. The value of each prize awarded will be reported for tax purposes as required by law. Each Winner is solely responsible for reporting and paying any and all applicable taxes. If the value of a prize meets or exceeds the $600 reporting threshold under applicable law, the Winner will receive an IRS Form 1099-MISC reflecting the value of the prize, and a copy of such form will be filed with the IRS. As a condition of receiving a prize, a Winner may be required to provide Sponsor with a completed IRS Form W-9 and any other documentation reasonably required for tax reporting purposes.

9. Privacy. Information submitted by Entrant will be subject to Sponsor’s Privacy Policy (“Policy”). Information collected in connection with the Sweepstakes will be used to administer the Sweepstakes in accordance with applicable laws. Sponsor will not sell Entrant information to unaffiliated third-party marketers. An Entrant may opt out of receiving promotional communications as set forth in the Policy or as provided within any such marketing materials. By entering the Sweepstakes, Entrant acknowledges that Entrant has read and agreed to the Policy, and that Entrant consents to the collection, use, and disclosure of Entrant’s personal information in accordance with the Policy.

10. Disclaimer. All prizes are awarded “as is” and WITHOUT ANY WARRANTY OF ANY KIND, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose), and all such warranties are hereby disclaimed.

11. Early Termination. Sponsor reserves the right to cancel, modify, or terminate the Sweepstakes if (i) fraud, misconduct, or technical failures destroy or threaten the integrity of the Sweepstakes, in the opinion of the Sponsor; (ii) a computer virus, bug, or other technical problem corrupts the administration, security, or proper conduct of the Sweepstakes as determined by Sponsor; or (iii) an act of God or other circumstance reasonably beyond the control of Sponsor adversely impacts the ability of the Sponsor to deliver the prize. In the event of early termination, Sponsor reserves the right to determine, but is not required to determine, any prize winner in a random drawing from among all eligible, non-suspect entries received as of the time/date of such termination.

12. Limitation of Liability, Release & Force Majeure. Sponsor, Sponsor’s affiliates, and any third-party platform where the Sweepstakes may be promoted are not responsible for: (i) technical problems or technical malfunction which may affect the operation of the Sweepstakes, including but not limited to: (a) hardware or software errors; (b) faulty computer, telephone, cable, satellite, network, electronic, wireless, or Internet connectivity or other online communication problems; (c) errors or limitations of any Internet service providers, servers, hosts, or providers; (d) garbled, jumbled, or faulty data transmissions; failure of any e-mail transmissions to be sent or received; (ii) lost, late, delayed, or intercepted transmissions; (iii) inaccessibility of any website, in whole or in part for any reason, or traffic congestion on the Internet; (iv) unauthorized human or non-human intervention of the operation of the Sweepstakes, including without limitation, unauthorized tampering, hacking, theft, virus, bugs, worms; (v) destruction of any aspect of the Sweepstakes, or loss, miscount, misdirection, inaccessibility, or unavailability of an account used in connection with the Sweepstakes; (vi) any typographical errors in the announcement of prizes or these Official Rules, or any inaccurate or incorrect data contained on any website; or (vii) any personal injury or property damage or losses of any kind which may be sustained to an Entrant or to any other person arising out of or relating to participation in the Sweepstakes or acceptance, use, or misuse of any prize.

Sponsor, Sponsor’s affiliates, and each of the foregoing’s respective subsidiaries, affiliates, successors, assigns, and each of the foregoing’s respective past and present officers, directors, owners, shareholders, members, managers, partners, principals, employees, attorneys, insurers, agents, and representatives (collectively “Released Parties”) shall not be liable for any injury, damage, loss, expense, accident, delay, inconvenience, or other irregularity that may be caused or contributed to (i) by any wrongful, negligent, or unauthorized act or omission of Entrant or any third party; or (ii) by any cause, condition, or event beyond the control of the Released Parties, including, without limitation, any act of God, war, pandemic, epidemic, terrorism, riot, hurricane, or fire.

BY ENTERING THE SWEEPSTAKES, ENTRANT IRREVOCABLY, FULLY, AND UNCONDITIONALLY RELEASES, DISCHARGES, AND HOLDS HARMLESS EACH RELEASED PARTY FROM AND AGAINST ANY AND ALL CLAIMS, COSTS, LOSSES, EXPENSES, ATTORNEY’S FEES, DAMAGES, AND OTHER LIABILITIES ARISING OUT OF OR RELATING TO ENTRANT’S PARTICIPATION IN THIS SWEEPSTAKES AND SWEEPSTAKES-RELATED ACTIVITIES (SUCH AS ACCEPTANCE, POSSESSION, USE, MISUSE, OR NON-USE OF ANY PRIZE), INCLUDING, WITHOUT LIMITATION, AND TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, DEMANDS, CLAIMS, AND CAUSES OF ACTION FOR NEGLIGENCE, DAMAGES TO PROPERTY, BODILY INJURY (INCLUDING DEATH), PROPERTY DAMAGE, LOSS OF BUSINESS, LOSS OF CONSORTIUM, CONSEQUENTIAL DAMAGES, PUNITIVE DAMAGES, AND ALL OTHER FORMS OF CLAIMS, LIABILITIES, AND DAMAGES.

NOTICE TO CALIFORNIA RESIDENTS: By entering the Sweepstakes, you acknowledge that you are familiar with the provisions of California Civil Code Section 1542, which provides that a general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party. By entering the Sweepstakes, Entrant hereby waives and relinquishes any right or benefit which Entrant has or may have under Section 1542 of the Civil Code of the State of California, or under any similar statutory or common law of any other jurisdiction, to the full extent that Entrant may lawfully waive such rights and benefits pertaining to the releases set forth in these Official Rules.

13. Arbitration; Dispute Resolution. All disputes arising under or related to these Official Rules shall be governed by and interpreted pursuant to the laws of the State of Texas and the United States of America without regard for conflicts of laws principles. All disputes arising under or relating to these Official Rules shall be submitted to and resolved by binding arbitration in Harris County, Texas, and any award shall be confirmed exclusively in the courts situated in Harris County, Texas. Entrant further irrevocably agrees and consents to the exclusive jurisdiction and venue of the courts situated in Harris County, Texas for the purposes of reviewing, confirming, or otherwise relating to any arbitration award, and Entrant hereby waives jurisdiction and venue in any other forum for such purposes. Any arbitration shall be conducted on a confidential basis pursuant to the Commercial Arbitration Rules of the American Arbitration Association. Any decision or award as a result of any such arbitration proceeding shall be in writing and shall provide an explanation for all findings of fact and conclusions of law, and shall be kept confidential and not disclosed for any purpose except as required by law, e.g., disclosure to tax advisors for the purpose of filing a tax return. Any such arbitration shall include a written record of the arbitration hearing.

14. WAIVER OF JURY TRIAL. ARBITRATION MUST BE ON AN INDIVIDUAL BASIS. YOU MAY NOT JOIN OR CONSOLIDATE CLAIMS OR PARTIES IN ARBITRATION, OR LITIGATE IN COURT OR ARBITRATE ANY CLAIMS AS A REPRESENTATIVE OR MEMBER OF A CLASS OR IN A PRIVATE ATTORNEY GENERAL CAPACITY, AND YOU HEREBY IRREVOCABLY WAIVE ANY RIGHT YOU MAY HAVE TO FILE ANY SUCH CLAIM OR PARTICIPATE IN ANY PROCEEDING IN ANY SUCH CAPACITY. YOU FURTHER HEREBY IRREVOCABLY WAIVE YOUR RIGHT TO A JURY TRIAL.

15. Third-Party Platforms. This Sweepstakes is not sponsored, endorsed, administered by, or associated with Apple, Meta (Facebook/Instagram), Google, or any other third-party platform. Any questions, comments, or complaints regarding the Sweepstakes must be directed to Sponsor and not to any third-party platform.

16. Winners List/Official Rules. To obtain a copy of the Official Rules and Winners list, send a request via email to colton@airiadevco.com or send a self-addressed stamped envelope to Sponsor at the address set forth above. Residents of Washington and Vermont are not required to provide a self-addressed stamped envelope for return postage. All such requests must be received within six (6) weeks after the final Winner has been announced.
